I see Tshirts, caps etc with popular band names, guitar brands...even automobile brands..
Is it legal to sell or produce Tshirts, patches & etc under these names and brands?

im just curious

Maybe those into/studying law can clarify..thanks

Maybe. If you made your own logo or something

But no I think its illegal if your not paying royalties or have permission or whatever

thats right ... brother ... its illegal to sell a product/brand name without permission from the higher authorities ... (but its nice tho wearing an ibanez t-shirt although its juz a copy of it, not the original from ibanez company)

Yes it's illegal. It's a not under the copyright law but under trademark, as Aenimic pointed out.

A very renowned sampler developer (will not mention which in this forum) had been developing lots of high quality samples. One of the sample libraries is that of a Rhodes. It has been out for a very long time - and very good samples too! But recently they got sued, not because they sampled a Rhodes, but because they used the name "Rhodes" which is trademarked. They had to permanently remove the products under that name. We're still waiting eagerly for the final outcome of that lawsuit. We're not sure how much Rhodes want them to pay. We're worried since they are a small company - one of those David vs Goliath thing again.

Well, Apple is taking new steps to protecting the name "iPod".

Got this quote:

"Apple Computer has slapped Podcast Ready with a "cease and desist" letter, claiming that the terms "Podcast Ready" and "myPodder" infringe on Apple's trademarks, and that they cause confusion among consumers. The company has been cracking down on use of the word "pod" by all sorts of parties, even though its trademark is for the word "iPod."

So now, we can't even use the word Pod. Imagine what's going to hapen to Line6 Pod. Their Pod products come out before the Apple iPod!

Apple is a bitch.it needs to get a bite out of everything.its not that iPod is such a versatile word anyways, till other people wanna use it too...

and cracking down on the word "pod" is mindless..then the band P.O.D got a serious copyright infringement problem to face....

1. a Trade Mark doesn't immediately invoke a legal effect. a Trade Mark merely means there is a business entity plying their operation by that name. if you put the entity concerned in bad repute/ profit from their good will, then it becomes a legal issue.

2. If you, at your own expense print a NIKE t-shirt for instance, it's not an issue. if you print the t-shirt & sell it to others to make money, that's not allowed.

Space Odyssey 2006:

"Close the pod bay doors, HAL!"

HAL: "I can't. I'm under restraining orders from Apple."

Get In To Trouble.

Just wonder? Will I get myself in to trouble if I buy/wear or even selling it to friend :?: Can anyone please tell me :?: :D

anyways,so this means all those T-Shirts in Penin are illegal huh?

if t-shirt companies are licensed by the manufacturer to reproduce their wares, then it legal. so next time you are there- ask.

the shopkeepers will either say yes..or come up with some lame confusing explanation..or they will juz go 8O
