I see Tshirts, caps etc with popular band names, guitar brands...even automobile brands..
Is it legal to sell or produce Tshirts, patches & etc under these names and brands?
thats right ... brother ... its illegal to sell a product/brand name without permission from the higher authorities ... (but its nice tho wearing an ibanez t-shirt although its juz a copy of it, not the original from ibanez company) :lol:
Yes it's illegal. It's a not under the copyright law but under trademark, as Aenimic pointed out.
A very renowned sampler developer (will not mention which in this forum) had been developing lots of high quality samples. One of the sample libraries is that of a Rhodes. It has been out for a very long time - and very good samples too! But recently they got sued, not because they sampled a Rhodes, but because they used the name "Rhodes" which is trademarked. They had to permanently remove the products under that name. We're still waiting eagerly for the final outcome of that lawsuit. We're not sure how much Rhodes want them to pay. We're worried since they are a small company - one of those David vs Goliath thing again.
Well, Apple is taking new steps to protecting the name "iPod".

1. a Trade Mark doesn't immediately invoke a legal effect. a Trade Mark merely means there is a business entity plying their operation by that name. if you put the entity concerned in bad repute/ profit from their good will, then it becomes a legal issue.
2. If you, at your own expense print a NIKE t-shirt for instance, it's not an issue. if you print the t-shirt & sell it to others to make money, that's not allowed.
