he may want to let it go peacefully but if the other party persists then i'm afraid there will be no peaceful resolution to this. anyway, your friend should really decide on the course of action to take to settle this. but we know for sure that the other party is not entitled to a refund.

coz the model its stated clearly and the pictures also...

Its the guy's loss cause he didnt do any research before buying the guitar. Its just kinda stupid for the guy to report your friend to MTI and ask for refund for a middle class acoustic guitar after he bought it.
Cause MTI deals more with international trade, you see.

Here are a few pointers where the dude can sue your friend if..

1.They have intention to create legal relations.
2.An agreement (Offer and Acceptance)
3.Consideration
4.They have capacity
5.They were not affected by reality of contract

I assume this scenario is classified under Commercial agreement.If they do not have a contract,the case is deem as a gentlemen's agreement.In other words agreement was binding in honour.So no contract equals court wont bother.

Another point I'd like to make about the Coke/Pepsi or Guitar/Piano scenario is that its classified under Common Mistake.

Both knew the agreement was about a guitar of particular specs and the transaction was about a guitar of that particular specs.So in conclusion no mistake hence no chance of refund/filing of law suit or whatever.

My advice to you for your friend is that the case here is never gonna make it in court.The judge is gonna have easy money on this case.

Im having Business Law test tomorrow.Thank god i can refresh my mind with this thread.

he actually mislead him into another guitar..

Woot, my business law next sem.

Anyway, I guess if it is an honest deal, plus its been months already, I don't think there is a valid reason to press charges. And if your friend wins the case, why not just forgive? If you dig more into it, generally more hatred is created...

Just get this over and move on with life. The guy is probably just scaring your friend with hopes of getting something in return. Just don't give in to him :)

This would be considered under Criminal Law if I am not mistaken.So far I havent heard of anyone press charges for such cases.Plus if you friend does wanna do so.Tell him dont waste his time.Its literally a waste of time.Lets say you lodge the case today,your case will be looked into months later.

So tell your friend there is nothing to worry about.
