Woah... you a law student, fibredrive?

As i recall, the law of misrepresentation can apply here. The defence of 'mere gimmick' as suggested by then Lord Denning only applies to cases where extravagant claims are made, for instance "This pill i'm selling can cure all diseases, including HIV!". Then, in that case, if anyone sued me for claiming my wonder pill can work miracles, I could say my statement was just a 'mere gimmick' because the majority of people would have known that my claim was simply too outrageous.

But in SL's case, the squire pic clearly shows a strat, and it is not such an unbelievable offer, so i think there is an arguable case for misrepresentation.

Sorry, i noe it's abit (ok, a lot) off the topic. Just thought it's an interesting situation, so just wanted to share some knowledge.
 
think apart from trade description act there's also sales of Goods act which has a similiar provision in it regarding what they advertise has to be accurate.

didn't know abt the pic depicting the squier strat, but if so, then yes, think its gonna be tough for them to siam liability.

we can, essentially, make them give us a squier strat for $99.

there was a similiar boo-boo sometime back where some online store advertised a palm pilot for only $99? - and in the subsequent action, they had to give those customers who oredered it the price stated on the site. i suppose the similiar concept can work here too.

and yep..studying law. finishing soon. yay.
 
Haha... but i'm sure they got put some disclaimer at the bottom of the ad, prob in font size 0.06 :twisted: ... those crafty buggers!

But if anyone is willing to try suing Swee Lee, tell us how it goes! Getting a free guitar would be a great start to the new year (even if it's just a squire!)

nahhh...doing UK law external degree la. no money fly there to study. even if got money if u kena 2nd lower honours come back also cannot practise...LL....heh.

To sidetrack abit:
While my friend and I were sitting on the steps of the Aljunied Mrt Station(waiting for his mum to fetch us home). This swee lee representative saw what my friend bought and sat down with us. He started talking about why they having this sale(something about clearing old stocks) and that the fender amp was made in China.), he then moved on to talking about how to maintain the amp(while smoking causing ashes to fly all over the place and on the guitar bag :x ) and why we must warm up our new amps and stuff. He also talked to us about not needing to change strings unless it snaps cause the rust can be removed.

Oh ya by the way, I almost forgot, he said that we shouldn't turn up our new amps too loud or else it will fuse, same for the guitars, he said the pickups will umm heat up and spoil.
 
I went down there today and yes the epiphone les paul sale is real...no money to buy though...i was wondering if they would put the jackson randy rhoads in the sale but they didnt...well there were a few keyboards there and dod pedals at 50 bucks each but not much variety. Go down to check it out if you're buying cause its kinda cheap after discount.

ya noe the washburn right ? they advertised in the pic a high end wood finish body.but at the sale they sold the lowest end solid colour (red blue and black) models
