Covering Songs = Infringing Copyrights?!?!

Ok this may seem weird, I've just received an email from youtube that my cover video has been taken down due to it infringing copyright issues!

I was pretty shock cause, I did the cover myself and the video only shows me and my guitar playing with the song in the background and taken with a handphone cam!

Plus the video has like close to a hundred thousands views, and now it has been claimed by youtube to be infringing copyright!!! I've posted a couple a of cover videos on youtube, and I think they will all be soon taken down!

actually not really.? theres like thousands and thousands of covers, and btw when i clicked your link they gave me this message "This video is no longer available due to a copyright claim by a third party. " THIRD PARTY!!! ftw! so one of those youtube buggers that think aiya this cover sucks, lets throw it away by sayings its copyrighted. :???:
 
that's why there's MySpace... haha

but this sounds like bull. even covers are copyright infringements? then let the police arrest all the other bands who play covers then. then we can all say (insert your own words here :DD)

So basically saying that cover songs and uploading it is actually infringing copyright... So if I were to play a cover song to an audience wouldn't it be the same thing!?

Any performance of copyrighted material requires a license fee be paid.
When you perform covers at a gig or a bar the venue would normally be paying a license to compass (local copyright collection agency)
 
Haha could be... Just kinda feel very weird that covers are being taken down. Its not like I'm uploading their official material or anything. Anyway more covers of that songs shows how popular that song/band is right, sorta like a tribute or w/e...
 
We should respect copyright, especially as musician who's intellectual property is what we pride so much.

It is not Youtube, record company or musician fault. It is a law that has been set to save guard the interest/welfare of those involved.

Solution? It is time to create our own originals.
 
This is an example of how out of touch music labels are with the fans. This is copyright law taken to the extreme. I wonder what harm they think will come out of allowing a video of a FAN playing along to a song.

Another interesting case was Prince covering Radiohead's Creep during a concert and then yanking fan uploaded videos of the performance on youtube. But the problem was he doesn't own the copyright , Radiohead did , so he actually had no right to do it.
 
I think its the song playing in the background. Usually the copyright is against public broadcasting.

With regards to this copyright issue for musicians, I think there needs to be some balance. Of course, those who stole the music and claimed them for their own is definately wrong. But established musicians who's songs were covered by others who gave credit shouldn't be so uptight. This is just my own personal view.

I was at Tommy Emmanuel's concert a couple months ago. He said there was once he had a concert in an European city which he had never performed before. I think it was Stockholm (can't remember what he said). The concert with 600 over seats were sold out and the organiser requested him to add another show which was sold out as well.

Tommy was puzzled. He had never been to that city to perform before and thought nobody knew him there. He hardly gets on the radio and only rarely on tv, so he thought people have no way to know him. When the concert there was over, he asked his fans at the autograph session and they all said that they saw him on Youtube. Thats why they knew about him to come for his concert even though they had never seen his live shows.

And then Tommy said that he is very thankful for whoever puts him on Youtube.

I also got to know Tommy Emmanuel through Youtube. If there is no youtube, there would not be so many sold out concerts for him.
 
Like what someone said, cover bands in clubs/ pubs have their COMPASS and PELU licences covered. As for those bands playing in public venues like Youth Park, etc., the venues are covered by an umbrella license as well.

As the old saying goes, "Everything is fine until you get caught..."

If you could, it's best to check with the original artists/ performers for permission like we did for our album. It's nicer and better to get their blessings and permission even if it's not for profit. Of course, it could be harder to get in touch with the MCR management.
 
unless you're playing a gig and charging people for it, cover should be no problem. I think in your vid you should include sth like "i do not own this vid" and watever
