Dead fret? Or what ever it is...HELP!!!!

My guitar's 12 fret sound the same as the 13th fret and i have to press the 12th fret damn hard in order for the real note to be heard if not it will sound the same as my 13th fret. Can anyone tell me wad the hell is it/wad is happening and is there any way to solve it w/o going for a set-up? Or is set-up the only way?

Sounds like your 13th fret is a tad taller that it needs to be. A light fret dress should do the trick.
